Consent Orders & Dispute Resolution

If you reach agreement regarding property settlement, child issues or both, you are able to document that Agreement in Consent Orders and ask the Court to make Orders in terms of the agreement reached by the parties. 

If the Court considers the agreement reached to be “just and equitable” (fair and reasonable) then the Court will make the Orders.

There are ways to resolve your family law disputes without proceeding to Court including:

Mediation involves creating solutions to negotiate an acceptable resolution to the issues.  This dispute resolution process requires the appointment of an independent third party to assist the parties to generate these solutions  and to help negotiate a mutually acceptable outcome.

Negotiation involves parties putting forward their rights and interests and altering their positions with a view to reaching a mutually acceptable agreement.  A third party is not involved in the negotiation process.  Negotiation is a key aspect of all dispute resolution processes.
